MedClick is provided by Second Opinion (Telemedicine Network) Limited ("SOUK"). By accessing any part of MedClick, you shall be deemed to have accepted these terms and conditions of use which include the Privacy Policy and the Links Policy ("Legal Notices"). If you do not accept these in full, you must leave MedClick immediately. Unless otherwise specified the materials on this website are directed solely at those who access this website from the United Kingdom.

The content of MedClick is provided for general information only and it is not intended to be, and should not be, treated or used as a substitute for the medical advice of your doctor or any other health care professional. We are not responsible for, and do not endorse, any external websites mentioned on MedClick. You should not use or rely on the information on MedClick or any external website to make any diagnosis or treatment decision. You should always consult your doctor or other healthcare professional if you are in any way concerned about your health.

Users of MedClick should be aware that MetLife does not provide and is not responsible for MedClick. MetLife therefore excludes liability for the contents of MedClick, including any errors, omissions or inaccuracy of the content of MedClick or any third party websites linked to MedClick. Access

You may access most areas of MedClick without registering your details with us. Certain areas of MedClick are only open to you if you register. To register, you must be the policyholder or an insured person entitled to cover under a group insurance policy provided by American Life Insurance Company ("Alico"), which trades as MetLife. To find out more about such policies, please contact MetLife using the details supplied on the policy. Registration will only be open to employees of Alico Management Services Limited, a provider of services, under existing services contracts, to Alico, after written notice has been given to employees that they can register. Additional terms and conditions apply for access to these additional areas of MedClick.

SOUK may revise any part of the Legal Notices at any time by updating this posting. You should check MedClick from time to time to review the then current Legal Notices, because it is binding on you.

Your rights to print and download extracts

You are permitted to print and download extracts from MedClick for your own use only. However, when doing so you must not modify documents or related graphics on MedClick and SOUK's copyright and trade mark notices and this permission notice must appear in all copies.

Unless otherwise stated, the copyright and other intellectual property rights in all material on MedClick (including without limitation photographs and graphical images) are owned by SOUK or its licensors, and you are not entitled to use the content other than for your own use. Other than printing and downloading for your own use no part of MedClick may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without SOUK's prior written permission.

Service access

While SOUK endeavours to ensure that MedClick is generally available SOUK does not provide an uninterrupted or error-free service and there will be defects with the service. In particular MedClick will be subject to times of unavailability. You should also use software which protects your computer from viruses as there may be viruses on MedClick, and we are not liable for this.

User material and conduct

Other than personally identifiable information, which is covered under our Privacy Policy, any material you transmit or post to MedClick , for example, the chat room shall be considered non-confidential and non-proprietary. SOUK shall have no obligations with respect to such material and shall be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all commercial or non-commercial purposes.

You are prohibited from posting or transmitting to or from MedClick any material:

that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or

for which you have not obtained all necessary licences and/or approvals; or

which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or

which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

You may not misuse MedClick (including, without limitation, by hacking).

SOUK shall fully co-operate with any law enforcement authorities or court order requesting or directing it to disclose the identity or locate anyone posting any material in breach of the Legal Notices.

Registration

If you have or are registering for services you shall provide SOUK with accurate and complete registration details and update these where any of your registrations details change.

Each registration is for a single user only. SOUK does not permit you to share your user name and password with any other person nor with multiple users on a network.

Responsibility for the security of any passwords issued rests with you.

Liability

As you should not use MedClick other than for information purposes only, MedClick and MetLife are not liable where you rely upon and use the information for diagnosis or treatment. SOUK and MetLife exclude liability for, any loss or damage that may arise as a result of any errors, omissions or inaccuracy in the content of any external websites linked to MedClick.

MedClick and MetLife are not liable for your inability to access or use MedClick.

Notwithstanding any provision to the contrary, we do not exclude or limit our liability for death or personal injury caused by negligence or our fraud.

Third party rights

Except as provided in clause 8.2, nothing in the Legal Notices are intended to confer on any person any right to enforce any term of the Legal Notices which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999.

The rights and benefits conferred by the Legal Notices to SOUK shall also be expressed for the benefit of and enforceable by any SOUK affiliate. The rights and benefits expressed for the benefit of MetLife shall be enforceable by MetLife. The parties to the Legal Notices may vary or rescind them without the agreement of SOUK affiliates or MetLife.

Subcontracting and Assignment

We may use affiliates or third party suppliers to supply MedClick. We may also assign the benefit of these Legal Notices or novate these Legal Notices to an affiliate, a successor business, transferred business or any supplier replacing SOUK as the provider of MedClick.

Governing law and jurisdiction

The Legal Notices shall be governed by and construed in accordance with English law. Disputes arising in connection with the Legal Notices shall be subject to the exclusive jurisdiction of the English courts.
